What I meant was BTCC teams breaking the test ban by running there cars under the guise of WTCC team.

ie, SEAT UK carry out test and development work with Jason Plato, under WTCC test regulations (not sure if there are any) and then use whatever they gain from the test in the cars they run on BTCC.

Under WTCC regulations, I understand that Jason Plato could legally test the Leon at Silverstone. What stops SEAT Sport UK asking the WTCC to allow Jason to test at every BTCC circuit before he competes there, and thus have an advantage next season?

I'm sure there will be some regulation somewhere that you already have in place, that I'm unaware of.

Very simple;

A driver competing in the BTCC cannot test at venues before we have raced there and the BTCC driver is subject to the BTCC testing restrictions.
